i. License
User shall have an unrestricted right to use the
JoeyGeneva.com site for entertainment use only. User agrees not
to use the information in the site for any other purpose,
including any illegal or prohibited activity. User agrees that
the content in the JoeyGeneva.com sites appears at the sole
discretion of JoeyGeneva.com. User agrees that JoeyGeneva.com
retains all intellectual property rights and copyrights on all
JoeyGeneva.com materials. User further agrees not to use
JoeyGeneva.com beyond the period of the Agreement, and not to
reverse engineer or create a derivative work from JoeyGeneva.com.
ii. User Fee
Our weekly NFL picks are free. The results of
our picks are never guaranteed, as that would be impossible.
However, we have had much success in the past, and our track
record speaks for itself. You must be aware and agree to these
terms. We could have a 90% win ratio one week, and a 5% win
ratio the next week. The JoeyGeneva.com member agrees
unconditionally to accept that risk.
iii. User Restrictions
We reserve the right to terminate any user account, at our
discretion, without prior consent or communication. Users are
limited to those 18 years of age or older.
iv. Nondisclosure of JoeyGeneva.com Information
User agrees that at all times during the term of this
Agreement, and for five(5) years thereafter, User will hold in
the strictest confidence, and will not use or disclose to any
third party, any confidential information of JoeyGeneva.com. The
term "confidential information of JoeyGeneva.com" shall mean all
non-public information that JoeyGeneva.com designates as being
confidential, or which, under the circumstances of disclosure
ought to be treated as confidential. If User has any questions
as to what comprises such confidential information, User agrees
to consult with JoeyGeneva.com. "Confidential information of
JoeyGeneva.com" shall not include information that was known to
User prior to JoeyGeneva.com' disclosure to User, or information
that becomes publicly available through no fault of User.
v. Liability
The liability of JoeyGeneva.com for any matters arising
under this agreement shall be limited to $1.00 USD.
vi. Warranty
JoeyGeneva.com disclaims all warranties. User agrees that
that JoeyGeneva.com is not responsible for incidental or
consequential damages from use or failure to use JoeyGeneva.com
by User or any Third Party.
vii. Arbitration
Any claim arising out of this Agreement shall be settled by
arbitration in the Commonwealth of Massachusetts, USA in
accordance with the rules of the American Arbitration
Association and judgment upon award rendered may be entered and
enforced in any court having jurisdiction thereof.
viii. Waiver of Breach
The waiver by either party of a breach of any portion of
this Agreement shall not operate or be construed as a waiver of
any subsequent breach. A waiver must be signed by an authorized
officer of the party.
ix. Governing Law
This Agreement shall be governed by and construed in
accordance with the laws of the Commonwealth of Massachusetts,
